Wash Appliance Rentals Terms and Conditions
Wash Appliance Rentals LLC. ("WASH") appreciates having you as a customer. By accepting and using Wash Appliance Rentals appliance(s) or ("equipment") constitutes your agreement to the following terms and conditions and lease agreement, including, without limitation, payment of rent at the rental rate shown on your order summary. 1. Rental Payments:
Lessee agrees to pay Lessor as rent for the Appliance(s) or Equipment the initial Monthly Rate plus applicable taxes prior to delivery and installation. Monthly payments are due on the same day of each month. Monthly rates include fees and applicable taxes.
2. Lease or Rental Term:
The lease term starts on the date the equipment is delivered and installed. Wash Appliance Rentals requires payment of rent for a minimum period of 60 days or 2 monthly rate payments, after which the lease continues as month-to-month until terminated. Lease is non-cancelable by Lessee. Lessee must give 30 days written notice of cancellation before the expiration of the lease term. Auto renewal will go into effect after the lease term has expired,6 month term. The new lease term will be month to month.
3. Late Charges:
If any amount under this agreement is more than 5 days late, Lessee agrees to pay a $10 late fee. This fee will be applied on the first calendar day following the due date.
4. Delivery:
Lessor agrees to deliver clean and properly functioning equipment. Service on the equipment will be at the expense of the Lessor. However, Lessee may be responsible for service due to neglect or misuse of the equipment by Lessee or Lessee's agent. You agree to use the equipment in accordance with the manufacturer's instructions as indicated on the inside lid or door of the equipment or inside the users manual. Lessee is not allowed to move the appliance(s) or equipment from the address on the agreement. Lessee must contact and schedule with Lessor to have equipment moved to a new location or address. Moving charges will apply if applicable.
5. Limited Warranty:
Upon delivery, inspect the equipment and report damage within three (3) business days. For mechanical defects due to manufacturing, Wash Appliance Rentals will repair or replace at no cost. Unauthorized repairs are prohibited. You agree that you or any unauthorized persons will not attempt to repair the equipment. You will be responsible for any damages due to faulty repair work done by anyone other than Wash Appliance Rentals contractors.
6. Possession and Surrender of Equipment:
Lessee shall be entitled to possession of the equipment on day one of the lease term. At the expiration of the lease term, Lessee shall surrender the equipment to the Lessor or Lessor's agent in good condition and working order. Ordinary wear and tear is expected, as it was at the commencement of the agreement.
7. Defaults:
You will be in default under your lease agreement and terms and conditions if any of the following should occur. You fail to pay the full monthly rate payment or any other applicable fees and taxes. Including any other charges when due. You breach any of the terms of your lease agreement or the terms and conditions or Wash Appliance Rentals in good faith believes the payment is impaired. You agree to waive any requirement that
Wash Appliance Rentals provide you with notice of default. Lessee shall have seven (7) days from the date of notice of default by Lessor to cure the default.
8. Indemnification:
Except for damages, claims or losses due to Lessor's acts or negligence, Lessee, to the extent permitted by law, will indemnify and hold Lessor and Lessor's property, free and harmless from any liability for losses, claims, injury to or death of any person, including Lessee, or for damage to property arising from Lessee using and possessing the equipment or from the acts of omissions of any person or persons, including co-renters, family members, guests, or invitees using or possessing the equipment with Lessee's express or implied consent.
9. Authorization Terms for Credit/Debit Card:
By providing your credit/debit card information, you authorize Wash Appliance Rentals to: Retain your card on file. Charge for monthly rent, past due balances, fees, damages and applicable taxes. Re-submitting any declined transactions. You may cancel this authorization with thirty (30) days written notice. Disputes are subject to the dispute resolution terms herein. Wash Appliance Rentals reserves the right to amend this authorization with reasonable prior notice.
10. Waiver:
The failure of either party to enforce any provisions of this agreement shall not be deemed a waiver of limitations of that party's right to subsequently enforce and compel strict compliance with every provision of this agreement. The acceptance of rent by Lessor does not waive Lessor's right to enforce any provision of this agreement.
11. Ownership:
This is a lease, not a purchase. Ownership of the equipment, appliance(s) are and shall remain the exclusive property of Wash Appliance Rentals LLC.
12. Use and Equipment Return:
Equipment or Appliance(s) are for personal use at the delivery address only. You must not move the equipment without Wash Appliance Rentals consent. If you relocate or move, Wash Appliance Rentals must handle the relocation of the equipment, subject to a $35 move fee. Monthly rent continues until Wash Appliance Rentals retrieves the equipment. If stolen or lost, Lessee is liable for the equipment's replacement cost and all associated collection costs.
